The Trade Remedies Authority of Vietnam has issued a notice inviting enterprises to consider submitting applications for exemption from the provisional anti-dumping measures on certain sorbitol products.
Specifically, the Trade Remedies Authority (Ministry of Industry and Trade) has notified enterprises to submit applications for exemption from the provisional anti-dumping duties (Case No. AD14) on certain sorbitol products (a type of sugar substitute or nutritional ingredient) originating from China, India, and Indonesia.
The application dossier must include documents as prescribed in Article 14 and Appendix III of Circular No. 37/2019/TT-BCT dated November 29, 2019 of the Ministry of Industry and Trade on trade remedy measures.
In accordance with Clause 3, Article 16 of Circular No. 37/2019/TT-BCT, applications for exemption must be submitted via the Online Public Service Portal at: https://dichvucong.moit.gov.vn or directly to the Trade Remedies Authority before 17:00 on August 8, 2021.
Previously, on July 6, 2021, the Ministry of Industry and Trade issued Decision No. 1719/QĐ-BCT on the imposition of provisional anti-dumping duties on certain sorbitol products originating from China, India, and Indonesia (Case No. AD14).
The affected sorbitol products are classified under HS codes: 2905.44.00 and 3824.60.00.
According to the Trade Remedies Authority, pursuant to Article 10 of Circular No. 37/2019/TT-BCT, the Minister of Industry and Trade may consider granting exemptions from provisional or official trade remedy measures for certain imported goods under the following circumstances:
- The goods are not produced domestically;
- The goods have distinct characteristics that cannot be substituted by domestically produced goods;
- The goods are specialized variants of similar or directly competitive products produced domestically;
- Similar or directly competitive goods produced domestically are not available in the domestic market under normal conditions;
- Domestically produced similar or directly competitive goods cannot meet domestic demand;
- The imported goods fall within the exempted quantity for purposes such as research, development, or other non-commercial uses.
Therefore, pursuant to Point (a), Clause 1, Article 16 of Circular No. 37/2019/TT-BCT, the Trade Remedies Authority hereby invites eligible enterprises to consider submitting applications for exemption from provisional anti-dumping measures on certain sorbitol products originating from China, India, and Indonesia.
